Lawyers for State Sen. Timothy M. Kennedy and challenger Betty Jean Grant will be back in court on Friday as Grant continues to dispute the razor-thin victory claimed by Kennedy in their Democratic primary contest.
Legal teams for both contestants met Wednesday in the chambers of State Supreme Court Justice Joseph R. Glownia but made no courtroom arguments. They said Glownia ordered them to appear again at 9:30 a.m. Friday.
Grant is seeking a judicial order to review a number of affidavit ballots ruled invalid by the Board of Elections. She also wants the court to supervise a "machine count" that would determine intent of some ballots that, for example, were cast by circling a name rather than filling in the circle next to the name.
"That would determine intent," she said Wednesday.
Kennedy has claimed victory in the race, with the latest official count giving him a 292-vote lead.
