Major legal challenge to NY-SAFE Act coming tomorrow

ALBANY -- The National Rifle Association's affiliate in New York will file a lawsuit in court tomorrow seeking to overturn the state's gun control law.

Tom King, president of the New York State Rifle and Pistol Association, would only say the suit will challenge "the constitutionality of a number of issues'' contained in the NY-SAFE Act, which was passed in January.

King would not say if the lawsuit will be filed in federal or state court, but said it would be made public about noon tomorrow. He said the lawsuit, though, will not deal at all with Gov. Andrew Cuomo's failure to let the bill age for the legal three days, as a separate lawsuit in state court is challenging. King said there are at least eight court decisions over the years giving wide latitude to governors to issue a "message of necessity'' to get around the three-day aging process.

NRA leaders during a recent large rally in Albany suggested the national group would help with the legal costs to try to overturn the New York law.
